** Gouvernance **
Je reviens d'une audition publique sur le Livre blanc sur la gouvernance
europeenne (Bruxelles, 16 mars 2001) ou ces sujets ont ete traites avec
pertinence par des intervenants de haut niveau d'experience et de competence
(ministres, secretaires d'Etat, Hauts fonctionnaires de l'U.E et de la
Commission, professeurs de sciences politiques dont les axes de reflexion et
de propositions ne different pas fondamentalement des notres.
Ils insistent sur la definition des competences (ouverte et souple,
negociable entre Conseil des Ministres, Commission, Parlements, et a travers
ceux-ci, jusqu'aux echelons regionaux et municipaux).
La sensibilisation et la participation de la Societe Civile leur parait a la
fois necessaire, urgente, et d'une mise en oeuvre malaisee. Ils soulevent la
question de la legitimite de la representation democratique des
organisations issues de la societe civile.
Il faudra suivre attentivement la genese du Livre Blanc, participer aux
prochaines auditions produire des propositions collectivement elaborees, en
concertation.
Le pouvoir arbitral et tutelaire des Etats est deja considerablement reduit
au point de n'etre plus dans les domaines economiques et financiers qu'un
pouvoir "symbolique" d'accompagnement et d'adaptation. Une mise en synergie
dans le cadre d'une U.E plus democratique et mieux structuree, integrant les
echelons regionaux, les villes (Eurocites) les
communes, dans un jeu de subsidiarite active proportionnee ouvrirait
peut-etre des perspectives vers un effort de controle plus efficace des
derives actuelles, par le soutien
populaire autant que par la solidarite des Etats Membres.
** Europe et Monde **
Je tiens a la disposition des participants au forum Gouvernance europeenne
toutes les contributions et syntheses du Forum Gouvernance Mondiale, qui
vont evidemment dans le sens de ta remarque, en la nourrissant d'une annee
d'echanges [<jacques@fph.fr>].
** Constitution Europeenne **
Elle a ete a l'ordre du jour lors de l'Audition du 16 mars a Bruxelles, ou
plusieurs intervenants ont insiste sur l'importance d'une demarche
d'elaboration democratique, tres participative, ouverte non seulement aux
Constitutionnalistes et autres juristes specialistes du droit international,
aux Hauts Fonctionnaires mais aussi a la Societe Civile(mais quid de la
selection de ses representants ?).
Le lien est fait avec la reflexion sur la Charte des Droits Fondamentaux.
** Charte Europeenne des Droits Fondamentaux **
Il est moralement incontournable d'elaborer un code de droits sociaux
europeen aligne sur le "mieux disant social". C'est tout aussi necessaire
que l'adoption de la monnaie europeenne pour un developpement economique
harmonieusement equilibre, preservant "un front commun de competitivite" a
forte plus-value sociale integree "hautement attractive" revendiquee a moyen
terme par les pays concurrents exterieurs.
** Droits Nationaux et Droit Europeen **
Meme remarque : le travail juridique constitutionnel doit affirmer le primat
d'un Droit Europeen et son respect dans chaque pays qu'il complete ou non
chaque Droit National qui peut subsister en coherence avec le Droit
Europeen.
** Opinion Publique Europeenne **
Pour tenter de remedier a cette lacune si regrettable, il faut imaginer la
creation de "collectifs d'intellectuels" engages dans la "construction"
d'une gouvernance europeenne - dans divers reseaux et associations-prenant
en charge un travail de "sensibilisation d'information et d'integration aux
debats " dans les milieux ou ils jouuissent d'une audience particuliere et
dans ceux qu'ils peuvent infiltrer.
Il nous appartient de donner l'impulsion en organisant "un suivi dynamique"
de nos forums, et en proposant a nos allies des colleges, chantiers, etc.
[de l'Alliance] et a leurs amis, de participer a une telle action.
** Passion, Imaginaire Europeen, Projet Mobilisateur **
Certes la "technostructuration " renforcee des institutions et l 'excessive
focalisation technocratique des preoccupations des hauts fonctionnaires,
ainsi que les strategies de pouvoir qui s'opposent autour de la Commission
entre Anglais, Allemands et Francais, ne sauraient susciter, parmi les
citoyens, le moindre interet, moins encore la moindre passion bien au
contraire.
Elles engendrent de plus en plus un grand scepticisme, un profond
"desamour".
Je pense, comme toi, Sandro, qu'il faut " desenclaver cette triste image" et
pour ce faire, "changer la donne", donner a croire que "le jeu peut
changer", que, "de nouveau " les enjeux sont ouverts et qu'il y a, pour
tous, "chance a saisir".
Le debat sur la Constitution peut etre, pour ce faire, le projet
mobilisateur ideal.

°°° Abstract: I deliver here my comments on the topical summary drawn up by
Sandro, facilitator of the forum Democratic Governance for Europe. °°°
** Governance **
I come back fromf a public audition on the White Book on European
governance (Brussels, March 16, 2001) where these subjects have been treated
with relevance by intervening parties with a high level of experience and
skills (ministers, secretaries of state, high commissioners of the U.E and
the Commission, professors of political sciences whose lines of thinking
and proposals don't fundamentally defer from ours.
They insist on the definition of skills (open and flexible, negotiable
between the Council of Ministers, the Commission, Parliaments, and through
these, to the regional and municipal levels).
The awareness and the participation of the Civil Society simultaneously
seems necessary, urgent, and of a difficult implementation. They raise the
question of the legitimacy of the democratic representation of the
organizations resulting from the civil society.
It will be necessary to attentively follow the genesis of the White book,
participate in the next auditions, produce some proposals collectively.
The arbitral and tutelary power of the States is already considerably
reduced to the point that in the economic and financial fields it is only a
"symbolic power" of continued support and adaptation. A synergy in the
framework of a more democratic and better structured U.E, encompassing the
regional levels, the cities (Eurocites) the
townships, in a game of commensurate active subsidiarity would open some
perspectives perhaps toward an more efficient control effort of the present
drifts, by the popular support
as much as by the solidarity of the Member states.
** Europe and the World **
I have at the disposal of the participants in the forum European Governance
all contributions and summaries of the Forum World Governance, which
obviously go in the direction of your remark, with the addition of one
year of exchanges [<jacques@fph.fr>].
** European Constitution **
It was on the agenda at the time of the audition of March 16 in Brussels,
where
several intervening parties have insisted on the importance of a democratic,
very participatory, procedure, open not only to the Constitutionalists and
other specialist jurists of international law, to the High commissioners but
also to the Civil Society (but quid of the selection of its
representatives?).

** European Charter of Fundamental Rights **
It is morally unavoidable to draw up a European code of social rights in
agreement with the "best social advocate." It is just as necessary as the
adoption of the European currency for an harmoniously balanced economic
development, preserving a "common front of competitiveness" with a high
increase in integrated social value, "highly attractive", demanded in the
mid term by the external competitor countries.
** National Rights and European Law **
Same remark: the constitutional legal work must affirm the primacy of a
European Law and its respect in every country, whether it completes or not
every National Law that may subsist coherently with the European Law.
** European Public Opinion **
To attempt to solve such a regrettable gap, it is necessary to imagine the
creation of "intellectuals groups" involved in the "making" of an European
governance - in different networks and organizations taking in charge a
work of "awareness of information and integration in the discussions" in the
contexts where they have a particular audience and in those that they can
infiltrate.
It is up to us to give a boost by organizing "a dynamic follow-up" of our
forums, and by suggesting to our Ally societies, workshops, etc. [of the
Alliance] and to their friends, to participate in such an action.
** Passion, European Imagination, Rallying Project **
Certainly, the reinforced "technostructuration" of the institutions and the
excessive technocratic focusing of the concerns of the high commissioners,
as well as the power strategies that oppose to each other around the
Commission between English, Germans and French, does not know how to
inspire, among the citizens, the least interest, even less the least
passion, quite the opposite .
They increasingly generate a grand skepticism, a deep "disappointment".
I think, as you do, Sandro, that it is necessary "to get rid of this sad
image" and to do so, " it is necessary to change the situation", to make
people believe in the fact that "the game may change", that, "again" the
challenges are open and that there is an "oppportunity to seize" for
everyone.
The discussion on the Constitution can be, to do so, the ideal project that
will stir people into action.
